If for any reason a claim proceeds in court rather than in arbitration, you and Costa Vida each waive any right to a jury trial and agree that such claim shall be brought and decided solely by a judge.

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.
